Dodd, A Real Democrat!

Harry Reid tabled the FISA bill just a few minutes ago.

There were a total of 10 who had backbone. Please remember them. Thank them. We will be back here in January, but these 10 were the ones who made a difference and stood up for the Constitution and the Bill Of Rights today. The other 90 were silent.

so either he's voting on a proposition he knows will fail to showcase his independence from the telecoms, or perhaps he has some character.

Time will tell.

It's off the floor but not off the table, so to speak (if I understand correctly).

A FISA bill will be reintroduced in January.  Whether the SIC telecom retroactive immunity version will be reintroduced, we don't know.

Is Harry being responsive, or were some of his votes out with the flu or campaigning?

Inquiring minds want to know.

Why the need to punish telecommunications companies for cooperating with the government during a time of war on an issue that is legally ambiguous?  If you want to clear up any uncertainty then by all means do so moving forward.  But opening up these companies to such liability would only seem to enrich trial lawyers.

I've got a copy on my bookshelf - link to a more in depth analysis on the merits of Dodd's opposition (his campaign literature has obviously been low on detail) and I'll check it out.

Is the retroactive immunity the only part of this bill you're opposed to?  It's the only provision I've heard anything about.

Article I, Section 9 (4.00 / 3)
"No Bill of Attainder or ex post facto Law shall be passed."

Retroactive immunity is a form of ex post facto law. The provisions protecting telecom companies are therefore flatly unconstitutional.

It also continues a broader trend of limiting the rights of citizens to address grievances with corporations or the government through the courts -- alongside the assault on tort law from a variety of sources and the truly alarming attack on habeus corpus -- that is effectively limiting individual access to the judicial system.

that not every effort to limit citizen access to the courts is unconstitutional, but the trend is sufficiently troubling that it motivates a lot of people's opposition to the telecom amnesty provisions.

Let's start with the simple (4.00 / 1)
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

There are cases that, if they go forward, will show that the Bush Administration violated the IV Amendment (above). Not only is this unconstitutional, it's illegal. Those that violated peoples rights could be found guilty and be made to serve tome. If it was done by executive order it would open up the executive branch to both criminal and civil prosecution.

By giving immunity to the telcoms all the cases against them would be dropped. The truth of what happened, who was spied upon, whose constitutional rights were violated by the government, and who was responsible, would forever be covered up.

If we are a country where the Rule of Law means anything, these cases must be allowed to go forward and the truth of any unconstitutional criminal activity must be brought to light so that those responsible can be help libel for their violation of our constitutional rights.

There was apparently one telcom that refused to participate in spying on Americans. For standing up for the constitutional rights of their subscribers this company has been forced to the edge of bankruptcy. Is it fair that the company that did the right thing should be forced to almost being out of business, but the companies that violated the rights of millions of Americans should benefit?

All these companies had a choice to make, and they should pay for their bad decisions. For violating the constitutional rights of their customer base. For telling us that we were protected as per the law and then violating that protection with impunity.

The question is not what you are, we already determined that, we are now negotiating price.

Why I like it here... (4.00 / 2)
I'm from Connecticut and as far back as I can recall politics has always seemed to me the most important and fascinating topic of discussion.  And while we disagree on a great many of the issues the alternative to talking to you is to blindly oppose you and quite frankly trading talking points back and forth doesn't seem very useful.  Particularly, since our form of government requires political compromise in order to function.

I've tried in my comments to join the discussion on issues rather than be reflexively partisan.  For those of you that have seem my (attempt) at blogging on my own site I'm sure you noticed a more partisan tone.  That kind of commentary would be inappropriate for me to post to myleftnutmeg and ultimately counterproductive.  that said, if you ever believe I've crossed a line let me know.

Since I'm not living in Connecticut at the moment (hoping to return in 2008 if possible) I view this forum as a place to have the conversations that would normally go on over a few beers with friends back home.  With the exception of my buddy working on the Dodd campaign its hard to wrangle up folks that want to argue about Connecticut.

Hey spazeboy,   Go for it.   But you won't have much audience, for if you check out redstate.com and freerepublic these days, you will find the posters scarce.    Could it be they are so depressed over their
choices and their party that they have nothing to talk about?       Or are they all busy on Anti-Hillary sites, trying the only way they know how to win,  i.e. tear down and smear the other candidates?

Makes me want to register Democrat before CT's primary so I can vote for him. Although he's a long shot, it is actions like this which makes me think that he is closest to the real thing when it comes to preserving our Constitution.
