FISA Update: A New Week of Calls

The San Francisco Chronicle has reported that California Democratic Senator Diane Feinstein will support retroactive immunity for telecommunications companies. This puts the official tally at two votes in favor and four votes opposed to telecom amnesty. We still need to convince six more Senators on the Judiciary Committee to oppose retroactive immunity to ensure that it is killed in Committee and doesn't reach the floor of the Senate.

This means one of the "nay" votes has to come from a Republican member of Committee, which does not seem incredibly likely. The Republican who we'd previously targeted as most likely to vote the right was was Arlen Specter of Pennsylvania. Since Specter has also introduced a proposal that would indemnify the telecom companies by making the federal government sole defendant in all of the pending cases against the industry. This proposal - retroactive immunity by another name - makes it look unlikely that Specter will oppose other forms of immunity.

There are two paths from here:

First, we must continue to call all members of the Senate Judiciary who aren't currently opposed and ask them to oppose retroactive immunity. Everyone is not opposed needs to hear from the public on this issue - even conservative Republicans - because the Constitution and rule of law are not partisan issues, nor should they be.

Second, if you're feeling discouraged by the increased chances of amnesty for telecoms making it out of the Judiciary Committee, remember that Senator Dodd has vowed to stop any such legislation from becoming law, either through a hold or by filibuster if necessary. Dodd will stand up for the rule of law. He will defend the Constitution.

Now is the time to take action, though. Chris Dodd won't wait until 2009 to lead and we shouldn't wait until 2009 to stand up for what we believe in.

My brother, a very astute politico, lives in the Bay Area and has been saying for years that DiFi is no friend of liberals.  After her vote on the Mukasey confirmation, we can't expect anything productive from her. I read this morning that she also has helped to toss a good deal of income in the direction of her husband's business.  Maybe tessa ought to bring her a Red Flag with an elephant on it . . . tparty is right: ugh!

Check those reports carefully.  I know the innuendo is out there and I am not a fan of some of Feinstein's recent votes (jolting me to look into her futher).  DiFi's husband, Richard Blum, is an investor, and in the last few years interest in a defense contractor called EG&G has come into his company's portfolio as a division of a larger company in which they invested.  Carlyle Group was the seller of the interest in the company; Carlyle owns 24% and Blum's company is second largest investor with 23%.  There was some question over the fpossibility she may have had the means to steer funds his way, as  DiFi was on the military contract appropriations committee at the time  of some contracts awarded to EG&G, I believe,  Since that time Feinstein has gotten off that committee and onto some forestry or environmentally related committee/s.  She's one of the wealthiest people in Congress -- and Richard Blum is also on the Board of the Carter Center, so seems to defy traditional stereotypes of defense contractors.  As I don't know much about defense contractor INVESTORS (he's not a contractor, he's an investor), I can't pass on any stereotypes to consider.

DiFi is also a card carrying member of AIPAC, and the pro-Likud stances that AIPAC seems to like to take are consistent with her hawkish stances.

Is she in her last term and therefore feeling less accountable?  In 2012, she will be 80.  Is she hanging out with Carlyle types and therefore more susceptible to their politics?  I couldn't say.

I wonder if, like Lieberman, she has long lulled voters with sufficient liberal issue votes (including largely symbolic votes on bills destined for the dustbin but helpful in establishing a liberal reputaiton), and events in the world have sharpened voter focus and swung their attention around to  her Bush supporting votes -- or if this voting pattern is something relatively new in the past few years.

She certainly has her detractors -- I'm just not sure if the full facts are out there to definitively prove any actual steering of benefits to her husband's investments, or whether suspicion that she has the means and the method have been sufficient to convince people that if it quacks anything like a duck, it must be a duck.

I thought it took 60 votes to pass anything in the Senate? That's the excuse we get when Dems can't pass troop-withdrawal amendments ... etc.

All Dems should threaten to fillibuster, not just Dodd. Glad to see Dodd leading the charge.

...assuming retroactive immunity gets out of the Senate Judiciary Committee, it will take 60 votes to pass it. Dodd will filibuster. Hopefully his colleagues will join him.

There hasn't been one Congressional representative so far who has been willing to filibuster this Administration. And there have been plenty of reasons to employ the filibuster.  Hurray for Dodd!
