What's A Little Waterboarding Between Friends?

Lieberman calls Chris Dodd and other Democrats "grossly unfair" for expecting the Attorney General nominee (and his Yale Law classmate) to answer whether he thinks waterboarding is torture before being confirmed:

Joe Lieberman, on the Senate floor just moments ago:

"To reject the nomination of Judge Michael Mukasey because he refuses to say what some members want him to say on this question, and he refuses as a matter of sincerely held legal belief...would be grossly unfair, an unjust act to this judge. May I suggest an alternative course...confirm him!"

Of course, lots of folks would argue that "this question" -- i.e., whether waterboarding is torture -- is kind of an important one.

Waterboarding is getting all the headlines. But, what about his views on Executive Power? Mukasey's view seems to be that GWB's treading on the Constitution is within bounds of Executive Power. To me, this is even more important than waterboarding.

Frankly, I'm surprised that Bush hasn't just declared that "waterboarding is not acceptable" to kill the issue and get Mukasey confirmed. We all know that in the end, they'll continue doing whatever the F they want in the secret prisons with no oversight whatsoever.
