Rell Vetoes CEP Fix Bill

CTNewsJunkie has a PDF of Rell's veto. Rell actually did the program a favor, as the State Constitution gives her 15 days to veto bills from a special session, and it was in her power to prevent the legislators from overriding the veto or crafting a new "fix" bill until after the primary.

Now, with the primary election about to be held and the general election campaign set to begin in a matter of days, I once again urge the General Assembly to reconvene as soon as possible -- this week, in fact -- to enact a more fiscally prudent response to the Court's decision -- one that does not include increasing the size of the grants. Such a bill would repeal those provisions that the court found to be unconstitutional and enact a true severability clause, rather than a reversionary clause. It would preserve the integrity of the CEP and allow it to remain a viable option for candidates in both statewide and local races.

She also criticises the fix for increasing only the gubernatorial grants and not the other statewide grants (a critique I agree with), and zings the legislature for not doing anything up through this point.

So can they override? My guess is no. The vote tally in the House (not available until today) shows passage by a margin of 74 to 45, which breaks down as:

Democrats
18 against
75 for
21 absent

Republicans
27 against
0 for
10 absent

That shakes out so that, even if all the remaining Democrats turned up and voted aye (which is already pretty unlikely), the override would come up six votes short. And insofar as some legislators may have voted nay because voting yes was politically difficult for them, switching their vote will be doubly so.

It would seem to me that Malloy and Federle would be at a severe disadvantage if they can't access additional funds. Federle made a strange point for a Republican, criticizing Rell:

Lt. Gov. Michael Fedele, who is participating in the public system on the Republican side, said Friday that he thinks it's strange Rell would want to veto a piece of legislation that is part of her legacy. He said the money was budgeted and he thinks whether it's him or Malloy challenging Ned Lamont or Tom Foley, the additional $3 million grant would have been triggered on day one.

"I don't believe it's going to cost anymore money," Fedele said.

But Sen. Gayle Slossberg of Milford is proving to be another legislative midget in the tradition of Jimmy "crusher" Amann.

Definitely wouldn't have been triggered on day one -- primary spending is isolated from the general election grants.

I tend to agree with those who spoke at the special session (I only watched about an hour) that said $3M is an unrealistically low sum to run a gubernatorial race. It's probably less than a Chris Murphy or a Jim Himes will spend in one-fifth of the state. But it's way, way down on the list of Good Reasons to Not Support Malloy, so I wouldn't lean on it, personally.
